A High Court judge has allowed attorneys for businessman Dominic Hadeed and his wife, Genevieve, to inspect police station diaries as they challenge the legality of the couple’s detention.
They were held as part of a police probe into a conspiracy to assassinate government officials.
During a habeas corpus hearing on Monday, Justice Frank Seepersad granted the request after the defence argued the arrests began as a routine criminal investigation but were later shifted under the Emergency Powers Regulations.
Senior Counsel Douglas Mendes said the couple was initially detained using ordinary police powers, with no indication of emergency legislation. He argued they were only placed under a Preventive Detention Order (PDO) after a habeas corpus application was filed, raising concerns about the process.
The State maintained detention orders were issued before the PDO. Justice Seepersad said the court has a supervisory role to ensure proper processes were followed.
The matter resumes tomorrow at 10am.
