T&TEC Takes Legal Action In Flavourite Foods Debt Case

The Trinidad and Tobago Electricity Commission (T&TEC) has initiated pre-action proceedings against Senior Counsel Keith Scotland and attorney Keisha Kydd-Hannibal over the failed recovery of 2.39 million dollars owed by Flavourite Foods Limited.

What began as debt recovery has turned into a major issue of public accountability.

Represented by Freedom Law Chambers and Former Attorney General, Senior Counsel, Anand Ramlogan, T&TEC has issued a Pre-Action Protocol Letter against Keith Scotland SC and Attorney-at-Law Keisha Kydd-Hannibal arising from their conduct of legal proceedings intended to recover approximately $2.39 million dollars in unpaid electricity charges owed by Flavourite Foods Limited.

According to T&TEC’s records, Flavourite accumulated millions of dollars in unpaid electricity charges over several years, while continuing to receive electricity despite repeated defaults, failed payment arrangements and dishonoured cheques.

In November 2022, T&TEC retained Senior Counsel Keith Scotland to recover the debt, but according to T&TEC’s investigations, it eventually resulted in the complete loss of its opportunity to recover the monies.

The first claim, filed in December 2022, was allegedly not properly served, with the claim being ultimately struck out automatically.

A second claim was then filed in October 2023, but T&TEC alleges that this claim suffered the same fate.

Throughout 2024, T&TEC was repeatedly assured that default judgement proceedings had been filed, were before the Registrar and were being actively pursued through the Court system, however when T&TEC investigated the matter, the Court’s records allegedly revealed that no such applications had ever been filed.

And…a third claim was allegedly filed in October 2024 – but T&TEC neither authorised nor had knowledge of these proceedings.

T&TEC further contends that the required permission of the Court was not obtained, that the claim was not successfully served, and that it ultimately collapsed.

According to Attorney Senior Counsel Anand Ramlogan, the issue is not that three claims failed, but that T&TEC was repeatedly led to believe that legal proceedings were advancing when, according to court records, essential procedural steps had not been taken.

He said T&TEC has commenced the Pre-Action Protocol process since it believes the public deserves answers.
