The Estate Management and Business Development Company Limited (EMBD) has successfully defended a lawsuit valued at approximately $24 million after the High Court dismissed a claim brought by Mainway Industrial Installation Limited.
In a judgment delivered on October 30th, the court rejected the claim in its entirety and ordered Mainway to pay EMBD’s legal costs.
The matter arose from two contracts worth more than $102 million for works at the La Romaine Residential Development and the construction of a ‘utility corridor’.
Mainway had sought approximately $9.4 million for construction works and a further $14.6 million in alleged late-payment charges.
EMBD was represented by Senior Counsel Anand Ramlogan and the legal team of Freedom Law Chambers, who argued that the claims could not be pursued more than a decade after the works were completed.
The Court agreed, dismissing the action and awarding costs to EMBD. Mr Ramlogan described the ruling as a significant victory that protected public funds from a substantial financial liability.
